Terms of Use (EULA)

1. Scope

These Terms of Use govern the use of the yuKast app ("App", "Service"), operated by Dennis Wilsmann and Mate Kurtin (simple partnership, "we"). By creating an account or using the App you accept these Terms.

2. Account and requirements

• You need an account (registration via our auth provider).
• You must be at least 16 years old.
• You are responsible for keeping your credentials confidential and for activity under your account.

3. User-generated content

• You remain the owner of the rights in the content you upload (photos, videos, text).
• You grant us a non-exclusive, worldwide, royalty-free right to store, process (including automated AI analysis for description, tagging and moderation) and display your content to other users within the scope of the Service.
• Any use of your content beyond the Service — in particular licensing to third parties (e.g. media) for a fee — only takes place with your separate, explicit consent. Without it, we use your content only as described above.
• You warrant that you hold the necessary rights in the content and that publishing it does not infringe any third-party rights (e.g. personality, copyright).

4. Rules of conduct and impermissible content

We have no tolerance for objectionable content or abusive users.

The following are prohibited in particular: - content glorifying violence, pornographic, sexually exploitative (in particular any depiction of minors), terrorist or otherwise illegal content; - hate speech, harassment, threats, bullying or discrimination; - false reports made with intent to harm, spam, fraud; - content that infringes third-party rights; - circumvention of security, moderation or blocking mechanisms.

5. Reporting and blocking

• You can report individual content (at Kastino level).
• You can block other users; their content will then no longer be shown to you.
• Reported content is reviewed promptly.

6. Moderation and measures

We reserve the right to review, hide or remove content and to warn, suspend or delete accounts in the event of violations. Automated pre-screening (AI moderation) may take place; final decisions may be made manually.

7. Availability

We strive to keep the Service working but do not owe uninterrupted availability. Features may change or be discontinued.

8. Liability

For damage caused by intent and gross negligence we are liable under the statutory provisions; an exclusion of this liability is barred under Art. 100 CO. Liability for slight negligence is excluded to the extent permitted by law.

In particular, we are not liable for indirect damage, consequential damage or lost profit, nor for damage arising from the use or temporary unavailability of the Service, nor for content published by users.

Mandatory statutory claims — in particular under the Product Liability Act — and liability for personal injury remain unaffected.

9. Termination

You can delete your account in the App at any time. We may terminate provision of the Service to you in the event of violations of these Terms.

10. Changes to the Terms

We may amend these Terms. We will inform you of material changes in an appropriate manner; continued use is deemed acceptance of the version then in force.

11. Applicable law / place of jurisdiction

Swiss law applies, excluding conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is, where permissible, Wilen bei Wollerau (domicile of the provider). Mandatory places of jurisdiction and protective provisions in favour of consumers are reserved.
